In truth, it was not really a ‘legal loophole’ but the unfortunate retailer in this case was obliged to refund the sale price as it had not provided information required by distance sales laws.
Incidentally, it’s similar for service and repair too. If retailers fail to provide distance sales information for service and repairs agreed by, for example, phone or email, the retailer may need to refund fees paid.
